  CONSTITUTION OF MOLMAT GROUP BURIAL SOCIETY. 'Adopted 04 August 2008

PREAMBLE

Members of individual families, individuals, friends and families:
(a)  Having realized the frustrations of death that as a
       society we are unable to get used to;
(b)  Cognisant of our family backrounds;
(c)  Having realized the need to help one another in
       times of death that is moving faster than a tropical
       cyclone;
(d)  Cognisant of our culture as black people without
       discrimination on the few white minority of our
       country;
(e)  Having gathered together bereby declare that:
       i)   We are unable to cary the burden of burial of
            our beloved ones as individuals;
       ii)  We need to come together and fold ourselves as
            a unit to wipe tears of another in times of distress
            such as death;
       iii) We, together , shall make it.

THEREFORE in pursuit of the above, we hereby resolve to find a voluntary association club in the form of a Burial Society whose purpose shall only be a helping hand to bury our beloved ones.
SECTION 4

LIABILITIES OF MEMBERS

a)    Members are liable for their monthly contributions
        to MOLMAT.
b)    Members who defaults payment for two months or
       more shall forfeit their funeral benefit in full and
       shall have no claim whatsoever against MOLMAT
       including refund of their contributions already
       made ( even if the two months are not consecutive
c)    Member who is on arears of two months shall not 
       settle immediately and claim but rather will be
       covered for claims of two months after settling the
       arrears on default, thus his forfeited right to claim
       will only be reinstated for further claims falling
       within the next two months from date of payment.  
d)   Member who relocates but continues to pay his/her
       monthly contributions will be deemed to be in good
       standing for as long as there are no defaults.
e)   Member has a duty to report death immediately or
       soon before three (3) days preceding the burial.
f)    Member is liable to provide a list of family
       members together with copies of their id books.
g)   Member is liable to disclose the full details of
       extended family members wished to be covered
       and be willing to pay an extra amount for such
       members.

SECTION 5

TERMINATION OF MEMBERSHIP

a)   A member shall be deemed to have terminated
       his/her membership if he stays in default for two
       monthly contributions or more.
b)   A member shall be deemed to have terminated
       his/her membership if he served one calender
       month notice to MOLMAT stating his/her withdrawal
       of membership.
c)    A member shall be deemed to have been
       terminated if due to his/her conduct, MOLMAT
       serves him/her with Notice of Termination of
       membership

SECTION 6

PAYMENT OF CLAIMS AND RENDERING A SERVICE

a)   MOLMAT shall settle all financial claims of
      members on good standing within fourty eight (48)
      hours of notification.
b)   MOLMATshall refer all disputed claims to the Board
      of Legal Advisors for review or for confirmation of
      cause of concern.
c)    Such referals as indicated on paragraph (b) aboce
       shall be determined by the legal Board as a matter
       of urgency and be finilised within twenty one (21)
       days from date of referal.
d)    MOLMAT shall establish a policy and forms on
       how to lodge claims by members to be attached
       hereto as Addendum "A".
e)   Member shall be illigible to claim after three
       months waiting period.
f)     Members shall be furnished with a copy of Terms
       and Conditions entailing same and is attached
       hereto and marked Annexure "B".

SECTION 7

COMPOSITION

MOLMAT shall be structured as follows:

a)    The President

b)    The Chairperson

c)    The Deputy Chairperson
d)    The Secretary

e)    The Assistant Secretary

f)      The Treasurer

b)       THE CHAIRPERSON

          i)   He/she administers the Branch upon which
                he/she is appointed for;
          ii)  He/she chairs all meetings convened by the
                said brach.
          iii)  He/she reports directly to the President.
          iv)  He/she is the Spokesperson of his/her Branch
           v)  In his/her absence the Deputy Chairperson
                takes over on similar terms.
 
c)       THE DEPUTY CHAIRPERSON

         i)   He/she acts on the stead and absence of the
              Chairperson.
         
d)       THE SECRETARY

         i)    Ensures that records are properly kept;
         ii)   He/she is the Chief Administrative Officer of 
               MOLMAT.
         iii)  He/she runs the day to day business of
               MOLMAT.
         iv)  He/she is the mouth piece of the Branch upon                  which he/she is appointed in the absence of
               the Chairperson.
e)       THE ASSISTANT  SECRETARY

         i)   He/she acts on the stead and absence of the
              Secretary.

f)       THE TREASURER

        i)   He/she confirms all payments to be made in                       consultation with the President.
        ii)  He/she ensures that he provides Annual
              Audited Statements at the end of each financial
              year.

SECTION 9
        
MEETINGS

a)    Meetings shall be convened between the
        Executive structures and at times with interested
        parties.
b)    There shall be two forms of meetings:
        i)  Special meeting: to deal with urgent pressing
            issues and;
       ii)  General meeting: to deal with general issues.
c)    Branches have a right to convene their own
       meetings in so long as such meetings do not
       coincide with the ones in the National Office.
d)   The President shall twice a year convene meetings
       of all structures herein.
   

SECTION 10

LEGAL STANDING

a)    MOLMAT is a Voluntary Association without right to
        sue or to be sued.
b)    MOLMAT has no interest in owning property other
        that cash in the bank.
c)    MOLMAT does however have a right to defend all
        Legal matters brought against it by members.


SECTION 11

PRINCIPLES

a)    Collective service.
b)    Criticism and self criiticism of MOLMAT.
c)    Ultimate attention to the bereaved.

SECTION 1

NAME
The name of the Burial Society shall be "MOLMAT GROUP BURIAL SOCIETY" herein referred to as "MOLMAT".

SECTION 2

AIMS AND OBJECTIVES

      i)   To create a voluntary association or Social Club
            to assist one another in times of bereavement;
      ii)   To work towards uniformity in burying our loved  
            ones;
      iii)  To offer proper last respect and dignity to those
            left in the form of death;
      iv)  To create an account with a financial institution
            into which monthly contributions will be  
            deposited consecutively each month and to be
            redeemed in times of death;
      v)   To assist one another with physical and financial
            support in order to make less the burden
            caused by the untimely deaths in our families;
      vi)  To regulate the manner in which such monthly
            contributions will be redeemed and or forfeited
            on inconsistencies upon deposits;
      vii) To create control measures on joining, staying
            as a member and termination or withdrawal of
            membership;
     viii) To create timeframes upon which help in terms
            of death shall be offered;
      ix)  To ensure decent burial shall befit the monthly
          contributions made consecutively by members     
           of the society (MOLMAT)
     x)   To establish committees that will be responsible
           for the day to day administration of the society
           (MOLMAT)
      xi)  To establish policies that will regulate payouts
            and stipends for those holding office on
            administrative basis;
      xii) To establish branches nationwide to further the
            purpose of the Association or Burial Society.

SECTION 3


FUNCTIONS AND POWERS

(a)  To determine from time to time an amount that 
       is acceptable to be a monthly contribution for
       specific standard of Burial of a member or his
       family.
(b)  To establish a Board of Legal Advisors who will:
       i)    Draft policies of the Society.
       ii)   Revise such policies from time to time to suite
             the best needs of the members.
       iii)  Confirm that there is compliance with policies
             and contributions of MOLMAT.
       iv)  Have a final say on acceptance and declination
             of claims of members.
       v)   Appear in all forums that Legal issues
       vi)  Administer the process of Disciplinary Actions
             against any member who is an office bearer
             and conducts himself in contravention of the
             constitution of MOLMAT and all its policies.
       vii) To validate or ratify co-options of office beares
             preceding the ones elected on adoption of this
             constitution.
c)   To strive at all times to cover the funeral costs af a
       member in line with his or her contributions to
       MOLMAT as far as possible.
d)   To outsource services of funerals to capacitated
       service providers of their choice.
SECTION 8

FUNCTION AND POWERS

a)    THE PRESIDENT
        i)   He convenes meetings of all Executives of all 
               Branches twice a year to assess performance.
        ii)   He chairs all meetings convened by him in
               terms of the constitution.
        iii)   He over sees all Branches and monitors their
               progress.
        iv)   He is the Chief Executive Officer of MOLMAT.
        v)    He, together with the Treasurer has right of
               access to the funds of MOLMAT.
        vi)   He authorizes all payments of claims and
               attendances of funerals.
